These Terms of Service govern your access to and use of duvise.org and any purchases made from DuVise (the “Services”). By visiting the site, creating an account, or purchasing a product, you agree to these Terms and to the policies linked on the site. If you do not agree, do not use the Services.

1. Online Store Terms

You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to use the Services. You may not use the Services or our products for unlawful, fraudulent, abusive, or unauthorized purposes.

2. Products and Availability

Products may be offered in limited quantities and may sell out. We make reasonable efforts to display colors, images, measurements, and product details accurately, but screens and production variations may affect appearance. We may limit quantities, discontinue products, or refuse or cancel orders when reasonably necessary, including for suspected fraud, pricing errors, inventory errors, or violations of these Terms.

3. Prices, Billing, and Orders

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Taxes, shipping charges, duties, and other applicable fees are calculated or disclosed during checkout when available. You agree to provide current, complete, and accurate billing, shipping, and contact information. An order confirmation does not guarantee acceptance; an order is accepted when it is processed for fulfillment.

4. Shipping, Returns, and Cancellations

Shipping estimates are not guaranteed and carrier delays may occur after an order leaves our control. Customers are responsible for entering a complete and accurate delivery address. Return, refund, exchange, final-sale, and cancellation rules are described in our Shipping & Returns policy, which is incorporated into these Terms.

5. Intellectual Property

The DuVise name, logos, artwork, graphics, product designs, photographs, text, and site content are owned by or licensed to DuVise and are protected by applicable intellectual-property laws. You may use the site only for personal, non-commercial shopping. You may not copy, reproduce, modify, distribute, resell, scrape, or exploit our content without prior written permission.

6. User Conduct

You may not interfere with site security, transmit malicious code, impersonate another person, collect information about other users without authorization, attempt to gain unauthorized access, or use the Services in a way that could damage DuVise, Shopify, our service providers, or other customers.

7. Third-Party Services and Links

The Services may rely on Shopify and other third parties for payments, shipping, analytics, marketing, and related functions. Third-party sites and services are governed by their own terms and policies. DuVise is not responsible for third-party content, availability, or practices except as required by law.

8. SMS Marketing Terms

If you separately opt in to DuVise SMS marketing, you consent to receive recurring automated promotional text messages at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Carriers are not liable for delayed or undelivered messages. For support, contact deez@duvise.org. Your participation is also subject to our Privacy Policy.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and site content are provided “as is” and “as available.” We do not promise that the site will always be uninterrupted, secure, or error-free. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of Liability

To the fullest extent permitted by law, DuVise and its owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.

11. Indemnification

You agree to indemnify and hold DuVise and its service providers harmless from claims, losses, and reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights, to the extent permitted by law.

12. Severability and Waiver

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of that provision.

13. Termination

We may suspend or terminate access to the Services for conduct that violates these Terms, threatens the site or another person, or is otherwise unlawful. Obligations that by their nature should survive termination will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. The revised Terms become effective when posted with a new “Last updated” date. Your continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
